Terms of Service

Please read this document carefully. By using Flixermen, you agree to the terms outlined below.

Version: 2026-07-28-v1 Effective Date: July 28, 2026 1. INTRODUCTION AND PARTIES This Customer Agreement ("Agreement") is between Flixermen Inc. ("Flixermen," "we," or "us") and you, the customer booking services through Flixermen.com or the Flixermen app ("you" or "client"). This Agreement takes effect at the time you complete a booking and governs that booking and any future bookings made through Flixermen. 2. ACCEPTANCE OF TERMS By accessing and using Flixermen.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. 3. DESCRIPTION OF SERVICE Flixermen is a home service marketplace that connects customers with qualified service professionals ("Flixers"). We facilitate the booking, scheduling, and payment for home services. 4. USER ACCOUNTS You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account. 5. INDEPENDENT FLIXERS All services are performed by independent subcontractors ("Flixers"). Flixermen is a booking platform and does not directly employ the Flixers. 6. ACCESS AND SAFETY The client must provide safe, clear access to the work area. Flixers may refuse unsafe or unsanitary environments, and a cancellation fee equal to one hour of service may apply, consistent with the Cancellation Policy in Section 17. 7. SCOPE OF WORK The booking covers only the services selected. Any additional work, materials, or added time beyond the booked scope will be billed in accordance with Sections 8, 9, and 10 below. 8. HOURLY BILLING PLEASE READ — HOW YOU ARE CHARGED Hourly bookings do not have a fixed price. You are billed for the time the Flixer actually spends on your job, plus any materials the Flixer purchases to complete the work. You will not be asked to approve the final amount. When the Flixer clocks out, your total is calculated automatically and charged to the payment method on file. An itemized invoice is sent to you at that time. By confirming your booking, you authorize these charges in advance. The rate. The hourly rate applicable to your booking is displayed to you in dollars before you confirm, and that rate does not change after booking. One-hour minimum. All hourly bookings are subject to a one (1) hour minimum. If the work is completed in less than one hour, you are billed for one hour. How time is measured. Billable time begins when the Flixer checks in on site through the Flixermen app and ends when the Flixer checks out. Check-in and check-out times are recorded by Flixermen's systems, not entered manually by the Flixer. How time is rounded. After the one-hour minimum, time is billed by 5 minute increments. For example, a job lasting one hour and ten minutes is billed as one hour and ten minutes. What counts as billable time. Billable time includes work performed on site and time spent traveling to obtain materials as described in Section 10. Billable time does not include the Flixer's travel to your location for the initial arrival, or personal breaks taken by the Flixer. The Flixer will pause the job clock in the app for any personal break. No fixed total at booking. Because hourly work is billed for actual time, the total cost of an hourly booking is not known at the time of booking. We display your hourly rate and the one-hour minimum. Authorization at booking. When you create your booking, we place a payment authorization on your card for the one-hour minimum. An authorization is not a charge. Automatic final charge. When the Flixer clocks out, Flixermen automatically calculates your total from the recorded check-in and check-out times, the applicable hourly rate, any materials purchased under Section 10, and applicable taxes. Your payment method on file is then charged that total automatically. You are not asked to approve the amount before it is charged. An itemized invoice showing the recorded times, rate, materials, receipts, taxes, and fees is sent to you when the charge is made. If you believe the invoice is wrong. Contact us under Section 25. We will review the recorded job data with you and correct any error. Separate days are separate jobs. Each day is billed separately. If the Flixer must return on a different day, that visit is billed as a new job with its own one-hour minimum. 9. ESTIMATE / BY-THE-JOB BILLING How a job by estimate is priced. For by-the-job work, the Flixer submits a quoted price through the app. You will receive a notification and must review and affirmatively approve the quote before any work begins and before any amount is charged. Your approval is recorded with the date, time, and the exact quoted amount and scope as presented to you. The quote is not always final. Additional work or materials may arise as the job progresses. Any such addition is handled under the change-request process below. Milestone structure. Approved estimate work is billed in three milestones: 25% upon your approval of the estimate, 50% at the midpoint of the job, and the remaining 25% upon completion. Payment authorization on approval. When you approve an estimate, we place a payment authorization on your card as follows: Estimates under $1,000 — we authorize the full approved quote amount. Estimates of $1,000 or more — we authorize the first milestone amount (25% of the approved quote). The authorized amount is shown to you at the time you approve. Authorizing an amount is not a charge; funds are captured as each milestone becomes due. Change requests. If the Flixer identifies additional work beyond the approved estimate, they will submit a request through the app describing the extra work and the additional cost. You must review and approve that request before it is added to your invoice or charged to your card. If you decline a change request, the original approved scope stands. Deposits and refundability. The initial 25% milestone is a deposit against scheduled work. If you cancel after approving an estimate but before work begins, the deposit is subject to the cancellation terms in Section 17. If Flixermen or the Flixer cancels, the deposit is fully refunded as described in Section 18. 10. MATERIALS AND PICKUP TIME You supply materials by default. The client is responsible for providing the materials needed for the job. Please have them on site before your appointment. If materials are not on site, the Flixer will purchase them. If any material required to complete the booked work is not available on site, the Flixer will purchase all materials required to complete the job. You will not be asked to approve the purchase in advance. Advance authorization. By confirming your booking, you authorize the Flixer to purchase the materials reasonably necessary to complete the work you booked, and you authorize Flixermen to charge your payment method on file for the cost of those materials. What you are billed. You are billed the actual cost of the materials purchased, plus the time the Flixer spends obtaining them at your applicable hourly rate. Both appear as separate line items on your invoice. Receipts. Materials are attached when we send your invoice. The Flixer submits receipts through the app. Receipts for your job are available to you in the app and on request. Limits. Materials purchased under this section are limited to those reasonably necessary to complete the scope of work you booked. Materials for work outside your booked scope require a separate booking or, for estimate work, an approved change request under Section 9. If you want to be asked first. Tell your Flixer before work begins. If you instruct the Flixer not to purchase materials without contacting you, the Flixer will contact you before purchasing, and the job may be paused or rescheduled while materials are obtained. 11. ARRIVAL WINDOW You will be given an arrival window for your appointment. Arrival times are estimates, and delays due to traffic, weather, or previous jobs may occur. We will notify you through the app or by text if we become aware that your Flixer will be significantly delayed. 12. CLIENT RESPONSIBILITIES Be present during the appointment or provide secure access. Remove valuables from the work area. Clearly explain all issues before work begins. Have required materials on site before your appointment, or expect the Flixer to purchase them under Section 10. For estimate work, respond to estimate approvals and change requests in a timely manner. 13. DAMAGE AND LIABILITY Flixermen is not responsible for: Hidden issues (for example: electrical, plumbing, structural) Pre-existing damage Damage caused by client-supplied materials Issues arising from misuse after the job Flixer insurance — please read Not all Flixers carry liability insurance. Flixers are independent contractors. Flixermen does not require every Flixer on the platform to carry general liability insurance. Some Flixers carry their own liability insurance and some do not. The "Require an insured Flixer" option. At checkout you may select the Require an insured Flixer option. When you select it, Flixermen will assign your job only to a Flixer who has provided Flixermen with current proof of general liability insurance. This option costs $15 and is disclosed to you before you confirm your booking. If you do not select it. Your job may be assigned to a Flixer who may not carry liability insurance. If property damage occurs on an uninsured job, there may be no insurance coverage available to you, and your recourse is against the Flixer directly, subject to the limitations in Section 24. 14. PAYMENTS AND AUTHORIZATION Payment method on file. A valid payment method must be on file to book and must remain on file through completion of your job. Authorization at booking. When you create a booking, we place a payment authorization on your card. An authorization is not a charge — it reserves funds and may appear as a pending item on your statement. The authorized amount is: Hourly bookings — the one-hour minimum (Section 8). Estimate bookings — the full quote if under $1,000, or the first milestone if $1,000 or more (Section 9). Automatic charge on completion. For hourly bookings, the authorized amount is typically less than your final total. When the Flixer clocks out, the final charge is processed automatically as a separate transaction against your payment method on file, without a further approval step. You may see the original authorization released and a separate charge for the final amount. What the final charge includes. Labor at the applicable rate, materials purchased under Section 10, approved change requests, and applicable taxes Invoice. An itemized invoice is sent to you when the charge is made, showing recorded times, rate, materials and receipts, taxes, and fees. If a payment fails. If your payment method is declined after work has been performed, we will notify you and attempt to collect using the payment method on file. You remain responsible for the amount owed for work performed. We may suspend future bookings until the balance is resolved. Statement descriptor. Charges from Flixermen appear on your card statement as [DECISION NEEDED: exact descriptor string from your Stripe settings]. 15. ELECTRONIC ACCEPTANCE AND RECORDS By clicking to accept these Terms, confirm a booking, approve an estimate, or approve a change request, you are providing a legally binding electronic signature under the federal E-SIGN Act and applicable state law, and you consent to transact with Flixermen electronically. Flixermen maintains a record of each such action, including the date and time, the version of these Terms or the exact amount and scope presented to you at that moment, and technical information such as IP address and device type. You agree that these records are admissible evidence of your agreement, and that they satisfy any requirement that an agreement be in writing. You may request a copy of the records associated with your bookings by contacting us at hello@flixermen.com. 16. VOICE & INFORMATION AI & Voice Data Voice recordings submitted through our platform are transcribed and used to improve your service request. Recordings are processed securely and not shared with third parties. We use your information to: facilitate service bookings, match you with qualified professionals, process payments, improve our AI assistant, communicate about your jobs, and enhance our platform. All phone calls are recorded for quality and insurance purposes. We share relevant project details with assigned Flixers to complete your service. 17. CANCELLATION POLICY Cancellations made 2 or more hours before the scheduled appointment are free, and any authorization placed on your card is released. Cancellations made within 2h hours of the appointment, or failure to provide access at the appointment, result in a cancellation fee equal to one hour at the hourly rate applicable to your booking. The exact dollar amount of this fee is displayed to you in dollars before you confirm your booking and again if you cancel. For in-person estimate appointments, cancellations made within 2 hours of the scheduled appointment will incur a $25 cancellation fee. After you approve an estimate, you may cancel the scheduled work up to 2 hours before the start time. If you cancel within 2 hours of the scheduled start, 10% of the initial 25% milestone payment will be retained as a cancellation fee, or the hourly rate advertised on the website, whichever is greater. For Video Estimate jobs billed as a single payment (not a milestone), if you cancel within 2 hours of the scheduled start, 10% of the total approved amount will be retained as a cancellation fee, or the hourly rate advertised on the website, whichever is greater. If your plans change, you may reschedule instead of canceling to avoid these fees. 18. FLIXER CANCELLATIONS AND NO-SHOWS If a Flixer cancels or fails to arrive for a confirmed appointment, Flixermen will notify you as soon as possible and offer to reschedule your appointment at no additional charge, with priority scheduling where available. No cancellation fee will be charged to you in this circumstance, and any deposit or milestone payment already collected for that appointment will be refunded or applied to the rescheduled appointment at your choice. 19. NO DIRECT HIRING Clients agree not to hire or contact Flixermen Flixers directly. All future services must be booked through Flixermen. 20. WORK GUARANTEE Workmanship is guaranteed for 30 days. This does not apply to client-provided materials, pre-existing issues, or anything unrelated to the work performed. 21. PHOTOS AND DOCUMENTATION Flixers may take before-and-after photos for proof of work, safety, and quality control. These photos, together with recorded check-in and check-out times and materials receipts, form part of the job record and may be used to verify work performed in the event of a billing question or dispute. If you submit photos or video through the platform (for example, for a Video Estimate), you grant Flixermen a non-exclusive, worldwide, royalty-free license to use, store, and display that content for purposes of providing the service, resolving disputes, and quality assurance. Flixermen will not use customer-submitted content for marketing purposes without your separate consent. 22. REFUND AND REPAIR If a job is not completed correctly or requires a follow-up repair, the client must allow us the opportunity to return and resolve the issue. If the client chooses to have the work fixed by another party without notifying us or allowing us to correct it, no refund will be provided. 23. DISCLAIMER OF WARRANTIES THE FLIXERMEN PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Flixermen does not warrant that the platform will be uninterrupted or error-free, and makes no representation regarding the accuracy of any estimate provided through the platform prior to a Flixer's on-site assessment. 24. LIMITATION OF LIABILITY Flixermen operates an online marketplace that connects customers with independent service professionals ("Flixers"). Flixermen is not a home-improvement contractor and does not perform, supervise, or direct the services. All services are performed by independent Flixers who are solely responsible for their own work, conduct, licensing, and results. Flixermen does not employ Flixers. Flixermen makes no warranty or guarantee regarding the quality, safety, timeliness, legality, or outcome of any services performed by a Flixer, and disclaims all implied warranties to the fullest extent permitted by law. Any claim regarding the services themselves is between you and the Flixer. To the fullest extent permitted by law, Flixermen's total aggregate liability to you arising out of or relating to these Terms, the platform, or any services booked through the platform shall not exceed the greater of (a) the total service fees Flixermen retained on the booking giving rise to the claim, or (b) one hundred dollars ($100). Flixermen shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, or property damage caused by a Flixer, even if advised of the possibility of such damages. Nothing in this section limits any liability that cannot be limited or excluded under applicable law. If any part of this section is held unenforceable, it shall be limited or modified to the minimum extent necessary, and the remainder shall stay in effect. 25. BILLING QUESTIONS AND DISPUTES Contact us first. If you believe a charge is incorrect, contact Flixermen at hello@flixermen.com or through the app within 60 days of the charge. We will review the job record with you, including recorded check-in and check-out times, photos, and materials receipts — and correct any error promptly. Before disputing with your bank. You agree to give us a reasonable opportunity to resolve a billing question before initiating a dispute or chargeback with your card issuer. Most billing questions are resolved faster directly with us. Records. In the event of a dispute, Flixermen may provide your card issuer with the job record, including your recorded acceptance of these Terms, your approval of any estimate or change request, recorded check-in and check-out times, materials receipts, the itemized invoice sent to you, and before-and-after photos. Account status. Flixermen may suspend bookings on an account with an unresolved disputed balance until the matter is resolved. Note: this section does not and cannot waive your rights under the Fair Credit Billing Act or your card network's rules. It is a good-faith process, and it also creates the paper trail that supports your position and ours. 26. RIGHT TO REFUSE OR CANCEL A BOOKING Flixermen reserves the right to refuse service, cancel a booking, or suspend an account at its discretion in cases of suspected fraud, abuse, safety concerns, or violation of this Agreement. Where possible, you will be notified and any amounts already charged for the cancelled booking will be refunded. 27. CHANGES TO THESE TERMS Flixermen may update this Agreement from time to time. Updated terms will be posted on Flixermen.com or provided through the app, and will apply to bookings made after the effective date of the update. Your continued use of the platform after an update takes effect constitutes acceptance of the revised terms. The version of this Agreement that governs your booking is the version in effect and presented to you at the time you completed that booking. 28. DISPUTE RESOLUTION — ARBITRATION AGREEMENT AND CLASS ACTION WAIVER PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. You and Flixermen agree that any dispute, claim, or controversy arising out of or relating to this Agreement or your use of the platform will be resolved through binding, individual arbitration rather than in court, except where prohibited by law. You and Flixermen each waive the right to a jury trial and the right to participate in a class action, collective action, or representative proceeding against the other. 29. GOVERNING LAW AND VENUE This Agreement is governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Except as otherwise required by the Arbitration Agreement in Section 28, any litigation arising out of this Agreement will be brought exclusively in the state or federal courts located in the State of New York. 30. GENERAL PROVISIONS Entire Agreement. This Agreement constitutes the complete agreement between you and Flixermen regarding your booking and supersedes all prior discussions or understandings. Severability. If any provision of this Agreement is found invalid or unenforceable, that provision will be modified to the minimum extent necessary or severed, and the remainder of the Agreement will remain in full force. 31. ACKNOWLEDGMENT By clicking to proceed with this booking, you confirm that you have read and agreed to all Terms and Conditions above, including the automatic charging described in Sections 8, 10, and 14, and the arbitration agreement and class action waiver in Section 28. Communications & Platform Safety To protect clients and Flixers, communications on Flixermen — including in-app chats and calls placed through the platform — are monitored and may be reviewed using automated tools. Do not exchange personal contact information or arrange payment outside Flixermen. All scheduling, estimates, and payments must go through the official platform. Attempting to move a job off-platform may result in suspension or removal.
